The Convention on the Rights of the Child on Article 28: The Right of the Child to Education.

អនុសញ្ញាស្ដីពីសិទ្ធិកុមារត្រូវបានអនុម័តដោយមហាសន្និបាត អង្គការសហប្រជាតិកាលពីថ្ងៃទី ២០ ខែវិច្ចិកា ឆ្នាំ១៩៨៩ គឺជាថ្ងៃដែលប្រារព្ធដោយសហប្រជាជាតិធ្វើជាទិវាកុមារសកល ។

ព្រះរាជាណាចក្រកម្ពុជា បានចូលជារដ្ធភាគីនៃអនុសញ្ញាស្ដី ពីសិទ្ធិកុមារនៅឆ្នាំ១៩៩២។ តាមរយៈការចូលជាភាគីនេះ ព្រះរាជាណាចក្រកម្ពុជា ប្ដេជ្ញាខ្លួន ការពារ និងបំពេញតាមសិទ្ធិនានារបស់កុមារទាំងអស់នៅកម្ពុជា ។

មាត្រា ២៨

១. រដ្ធភាគី ទទួលស្គាល់សិទ្ធិកុមារ ក្នុងការទទួលបានការអប់រំ ហើយដើម្បីអនុវត្តសិទ្ធិអោយកានតែប្រសើរឡើងជាលំដាប់ និងផ្អែកលើមូលដ្ធាន  នៃអោកាសស្មើភាពជាពិសេស រដ្ធភាគីត្រូវ៖

ក, ធ្វើអោយការអប់រំ កម្រិតបឋមមានលក្ខណៈជាតព្វកិច្ចនិងឥត បង់ថ្លៃ សម្រាប់គ្រប់គ្នា ។

ខ, ជំរុញការអភិវឌ្ឍន៍ទម្រង់ផ្សេងៗ នៃការអប់រំកម្រិតមធ្យម រួមមានការអប់រំចំណេះទូទៅ និងវិជ្ជាជីវៈផង បើកអោយមាន និង ទទួលបានដល់កុមារគ្រប់រូប និងចាត់វិធានការសមស្របនានា មានជាអាទិ៍ ការបង្កើត ការអប់រំឥតបង់ថ្លៃ និងការផ្ដល់ជំ នួយហិរញ្ញវត្ថុក្នុងករណីចាំបាច់ ។

គ, ធានាតាមគ្រប់មធ្យោបានសមស្រប អោយមានការអប់រំថ្នាក់ឧត្ដម សម្រាប់ជនគ្រប់រូប ដោយយកសមត្ថភាពជាមូលដ្ធាន ។

ឃ, បើកអោយមាន និងធ្វើអោយកុមារទាំងអស់ បានទទួលព័ត៌ មាន និងការណែនាំស្ដីពីការអប់រំ និងវិជ្ជាជីវៈ ។

ង, ចាត់វិធានការជំរុញអោយមានការចូលរៀនទៀងទាត់ និងកាត់បន្ថយអត្រាបោះបង់ចោលការសិក្សារ ។

២. រដ្ធភាគី ត្រូវចាត់វិធានការសមស្រប ដើម្បីធានាថា វិន័យសាលាត្រូវបានអនុវត្តក្នុងបែបផែន ស្របនឹងសេចក្ដីថ្លៃថ្នូរជាមនុស្សរបស់កុមារ និង ស្របតាមអនុសញ្ញានេះ ។

៣. រដ្ធភាគី ត្រូវលើកស្ទួយ និងលើកទឹកចិត្តដល់សហប្រតិបត្តិការអន្តរជាតិក្នុងវិស័យអប់រំ ជាពិសេសដើម្បីរួមចំណែកលុបបំបាត់ភាពអវិជ្ជា និងអនក្ខរភាពទូទាំងពិភពលោក និងដើម្បីសម្រួលសិទ្ធិទទួលបាននូវចំណេះដឹងផ្នែកវិទ្យាសាស្ត្រ និងបច្ចេកទេស និងវិធីបង្រៀនបែបទំនើប ។ ក្នុងបញ្ហានេះ ត្រូវយកចិត្តទុកដាក់ជាពិសេសលើសេចក្ដីត្រូវការរបស់ប្រទេសដែលកំពុងអភិវឌ្ឍន៍ ។

The convention on the Rights of the child was adopted by the General Assembly of the United Nation on 20 November 1989 the day celebrated by the United Nations as Universal Children’s Day.

The Kingdom of Cambodia acceded to the CRC in 1992. Through this act, the Kingdom of Cambodia has committed itself to protecting and fulfilling the rights of all children in Cambodia without distinction. 

Article 28

1. States Parties recognize the right of the child to education, and with a view to achieving this right progressively and on the basis of equal opportunity, they shall, in particular:

(a) Make primary education compulsory and available free to all; 

(b) Encourage the development of different form of secondary education, including general and vocational education, make them available and accessible to every child, and take appropriate measures such as the introduction of free education and offering financial assistance in case of need;

(c) Make higher education accessible to all on the basis of capacity by every appropriate means;

(d) Make education and vocational information and guidance available and accessible to all children;

(e) Take measures to encourage regular attendance at schools and the reduction of drop-out rates.

2. State Parties shall take all appropriate measures to ensure that school discipline is administered in a manner consistent with the child’s human dignity and in conformity with the present convention.

3. State Parties shall promote and encourage international cooperation in matters relating to education, in particular with a view to contributing to the elimination of ignorance and illiteracy throughout the world and facilitating access to scientific and technical knowledge and modern teaching methods. In this regard, particular account shall be taken of the needs of developing countries.
